Privacy Policy
Introduction
Cypress Communications, Inc. (“Cypress”) is committed to the privacy of its customers (“Customers”) and other visitors to Cypress’s website (“Visitors”) (collectively, “Users”). Cypress adheres to all laws and regulations in the United States applicable to its use and disclosure of Users’ information.
Except as set forth in this Privacy Policy, Cypress will not trade, sell or disclose to any third party any form of a User’s personally identifiable information (“PII,” which is described more fully below) without that User’s consent. Additionally, Cypress will not disclose or make available any User’s PII to any third parties seeking to market third-party products, without that User’s consent. Cypress has set forth this Privacy Policy to explain to Users how Cypress collects information from Users who access the Cypress website (“Website”) or otherwise provide data to or communicate with Cypress, and how Cypress uses such information.
Collection and Use of User PII
Cypress may collect User data via the Website, through forms or email links that allow Users to request information about Cypress and its products and services. Additionally, Customers may sign up for online access to their Cypress account. Related to the above purposes, Cypress may request and collect a User’s PII, including name, address, phone number and e-mail address; and Users may provide Cypress with such other information as they may desire. When Cypress collects User PII in such fashion, Cypress uses the PII solely for the purpose of providing products and services to Customers, responding to Users’ requests (which responses may include news alerts and other information about Cypress) and otherwise communicating with Users.
The Website also provides capability for Users to submit their resumes to Cypress via e-mail. Any resume so received by Cypress will be held in confidence and used only for the purpose of considering the submitting party for employment or such other purpose as requested by the submitting party. Such information is not shared with third parties (other than contractors retained by Cypress to assist in its hiring process) unless specifically requested or authorized by the submitting party. Collection and Use of Non-PII
Cypress may collect non-personally identifiable information ("Non-PII") from Users regarding usage of Cypress services or the Website. Non-PII is generally used to optimize the Website and Cypress’s products and services so that same are more beneficial to both Customers and Visitors. Non-PII may include website pages viewed, time spent using certain services, demographic data, cookies and other information which does not specifically identify any one individual.
Web cookies or HTTP cookies utilize PII.
Cookies are parcels of text that may be placed on a computer by a website for the purpose of facilitating and enhancing communication and interaction with that website. Cookies are used for authenticating, session tracking, and maintaining specific information about users, such as site preferences or the contents of their electronic shopping carts. Many websites use cookies for these purposes. Cypress may use cookies to customize Users’ visits to the Website and for other purposes to make Users’ visits more convenient or to enable Cypress to enhance its Website, products and/or services.
In addition to cookies, Cypress may also use (and its third-party advertisers may use) clear gifs, web beacons and third-party cookies to improve the performance of the Website, provide certain features such as advertising or to track anonymously usage of the Website and/or to track the online activity of Users. Cypress may also use such devices in its HTML-based emails to track the usage of such emails in much the same manner as usage of the Website is tracked.
A User may stop or restrict the placement of cookies, including third-party cookies, on User’s computer, or flush cookies from the User’s browser by adjusting web browser preferences, in which case the User may still use the Website, but such adjustments may interfere with some Website functionality.
Additionally, Cypress may use User IP addresses to help diagnose problems with its server, to administer the Website, to analyze trends, to track Users’ movement through and use of the Website, and/or to gather broad demographic information. Such data is not linked to any personally identifiable information and thus is not “PII,” as that term is used herein.
General Exceptions
The above-described restrictions notwithstanding, Cypress may use User information (including PII and Non-PII) to the extent reasonably necessary to: (i) correct technical problems and malfunctions in how Cypress provides its services to Customers and to technically process Customers’ information; (ii) protect the security and integrity of the Website and Cypress’s services, including without limitation, the enforcement of Cypress’s Terms and Conditions with a Customer; (iii) protect Cypress’s rights and property and the rights and property of others; (iv) take precautions against liability; (v) respond to claims that a User’s information violates the rights and interests of third parties; (vi) meet legal requirements or to respond to judicial process or both; and/or (vii) provide personal information to law enforcement agencies or for an investigation on a matter related to public safety.
Additionally, User understands and agrees that technical processing of User information may be required (a) to send and receive messages regarding User’s use of the Website; (b) to conform to the technical requirements of connecting networks; (c) to conform to the limitations of Cypress’s service; or (d) to conform to other, similar technical requirements.
Cypress may also pass on User information (including PII, Non-PII, and CPNI) to a successor in interest, where such successor merges with or acquires Cypress or purchases all or substantially all of Cypress’s assets.
Cypress may use or disclose your information (including PII, Non-PII, and CPNI) as permitted or required by federal statute (e.g., 47 U.S.C. § 222, and 47 U.S.C. §§1001-1010) and federal regulations (e.g., 47 CFR §§ 64.2001 - 64.2009, and 47 C.F.R. §§ 1.20000 – 1.20008).
Children's Privacy Policy
Cypress does not sell products or services for purchase by children. Cypress does not knowingly solicit or collect PII from children or teenagers under the age of eighteen. If you believe that a minor has disclosed PII to Cypress, please report such disclosure to Cypress at support@cypresscom.net.
Spam Policy
Cypress has zero tolerance for spam. Spam complaints will be dealt with seriously and can result in losing Cypress privileges, including but not limited to loss of a Customer's account. If you receive spam and want to report it to Cypress, please forward the email you received to support@cypresscom.net.
Third Party Websites and Services
The Website may contain links to other websites not maintained by Cypress. In addition, other websites and services may also reference or link to the Cypress Website. Cypress encourages Users to be aware when leaving the Cypress Website, or surfing the Internet generally, to read the privacy statements of each and every website and service visited. Cypress does not endorse, screen or approve, and is not responsible for the privacy practices or the content of, such other websites or services.
Cypress does not assume any liability for third parties that have been provided with information as permitted by this Privacy Policy or who have collected information as permitted by this Privacy Policy (such as advertisers using third- party cookies).
Anti-Spyware Policy
Cypress forbids any Cypress employee, agent, partner, affiliate or contractor from intentionally deploying or using “Spyware,” which term means any executable software application that covertly gathers and transmits PII through the User's Internet connection without the knowledge or consent of the User. Cookies and web beacons are not considered Spyware. Spyware may gather PII, such as e-mail addresses and credit card information, and may even alter personal computer settings. Intentional use of Spyware by any Cypress employee, agent, partner or affiliate on Cypress’s behalf will not be tolerated and will be considered grounds for dismissal, contract termination and/or loss of payment.
Corrections/Updates
Customer may change or modify information previously provided to Cypress through the Website via e-mail to support@cypresscom.net.
Security
The Website has security measures in place to protect the loss, misuse and alteration of the information under Cypress’s control. Access to such information is limited to those required to fulfill the applicable User requests.
Changes to Privacy Policy
Cypress may amend its information practices as described in this Privacy Policy. If Cypress does so amend, it will post on its Website’s home page a notice or a link to a notice which will describe how Cypress will amend its Privacy Policy. If Customer does not agree to Cypress’s amended Privacy Policy, Customer may contact Cypress as described herein, and Cypress will allow Customer to opt out of the proposed amendment to its Privacy Policy, but only with respect to the information that Cypress Communications would have previously collected from Customer. Users are encouraged to check the Website regularly for information about revisions to this Privacy Policy. Except as provided above, if Cypress changes this Privacy Policy, such changes will affect all of the information Cypress has previously collected from Customer, as well as the information Cypress Communications collects after any such change.
Export
The Website is maintained in the United States. Each foreign User that provides information (including PII and Non-PII) as described above authorizes the export of such information to the United States to be used as set forth in this Privacy Policy.
CPNI: Opting Out
Customer Proprietary Network Information (CPNI) includes information that relates to the quantity, technical configuration, type, destination, location, and amount of use of a telecommunications service subscribed to by a customer of Cypress, and that is made available to the carrier by the customer solely by virtue of the carrier-customer relationship, including information contained in the bills pertaining to telephone exchange service or telephone toll service received by a customer of Cypress. As a Cypress customer, you have the right to impose additional restrictions on Cypress’s use of your CPNI by "opting out." If you opt out, Cypress cannot use your CPNI to market additional services to you. Opting out will not affect the provision of any Cypress service to which you already subscribe, but it may prevent you from receiving certain information about additional services from Cypress. If we do not hear from you within 30 days after you first sign up for Cypress service, we will assume you do not wish to opt out. However, you can choose to opt out at any time. Your decision whether or not to opt-out will remain in effect until you change it. In order to opt out, you must notify Cypress in writing at Cypress Communications, Four Piedmont Center, Suite 600, Atlanta, GA 30305, Attention: Marketing, and please provide the following information: (1) customer name, (2) service billing address, (3) telephone number including area code, and (4) service account number.
